THE OUTLINE OF THE FUNCTION PREROGATIVE FORUM

Resumen

The privileged forum has been an issue widely debated in Brazil, especially after the last decision of the Federal Supreme Court that restricted the privileged forum of deputies and senators, yet this prerogative that some authorities have in Brazil still encompasses many people. The special forum per function prerogative is established considering the position or function that the persons occupy, in order to protect the function and the public thing. The forum is linked to the function and not to the person, that is, this way of determining the competent judge body does not follow the person after the end of the exercise of the mandate. The present paper aims to analyze the issues that involve the formation and organization of the forum by privilege function in Brazil, based on a qualitative research, with renowned doctrines of law and from the decision of the STF, considering the importance of discussion of the topic raises it is questioned whether or not it continues in the orbit of the Brazilian system, concluding the need for greater debate and further development on this institute.
